Cybex Recalls 15,000 Defective Weight Press Products
Cybex International, a popular American manufacturer of weight lifting equipment, has issued a recall for approximately 15,000 Cybex Smith Presses. According to the company, the weight bar can become dislodged and fall on the person using the equipment. To date, there have been 27 reported injuries, including spinal fracture and paralysis.
There are two models being recalled:
- 5340, manufactured and distributed between 1989 and 1993. At this time, no repairs are being made, but consumers can contact Cybex about a full refund or credit for their presses.
- 5341, manufactured and distributed between 1993 and 2009. Cybex is offering to repair these models for free.
The total estimated cost of these products falls between $1,000 and $3,000, per press.
According to the recall notice published by the Consumer Product Safety Commission, “The models have a weight bar seated between two parallel vertical tracks on latch pins. The weight bar can be moved up and down to perform upper body and lower body exercises. The equipment is used primarily in fitness facilities. The weight bar was sold with the Smith Press, and the weights were sold separately. The model number is printed on the base of the frame of the Smith Press equipment.”
What do I do if I have a defective Cybex Smith Press?
If you own a defective press, stop using it! Individual owners and gym owners can call Cybex directly (M-F, 7:00am to 6:00pm CT) at this toll-free number: 877-423-3253. You can also contact the company through its online support network. We encourage you to report any problems you may have had as well, including injuries you or your loved one sustained.
What do I do if I’ve been injured while using a Cybex Smith Press?
If you were injured while using a defective Cybex Smith Press, you should seek medical attention immediately. There is no such thing as a “minor” spinal fracture, or an “insignificant” spinal cord injury. These are serious, often life-altering injuries that can worsen over time, especially if you do not seek treatment. If the weight bar fell out of its arms and onto you, you could end up with nerve damage. You could also develop a condition called paresthesia, which causes a constant tingling or burning sensation in your extremities.
Making a claim if you were injured by a defective product
If you sustained an injury of any kind while using defective weightlifting equipment, you may be able to make a claim for damages: for your lost wages, for your medical bills, and for your pain and suffering, among other potential factors. Though Cybex has not said specifically, the recall seems to indicate that there was a flaw in the way the bar or the arms were designed, which means you can file a product liability claim in order to collect damages. Product liability can also include a manufacturer’s failure to warn consumers about potential dangers.
