New York Legislature Considers New Medical Malpractice Bill
New York state lawmakers are considering a bill that would change the statute of limitations on medical malpractice cases, giving patients more time to file a medical malpractice suit. Currently, New York law states that victims of medical malpractice must file a lawsuit within 2 ½ years of the malpractice occurring. However, the bill would amend the time limit to 2 ½ years from when the victim first realizes they were harmed by a medical professional, so long as it is not more than 10 years after the harm. Often, patients don’t realize that they have been harmed or misdiagnosed by a physician for months, or even years. Therefore, it is unjust to “start the clock” to hold the physicians accountable at the time of the incident, as opposed to upon the victim’s realization.
