Birth Control Device Case Against Bayer is Allowed to Proceed
A Federal Judge in Philadelphia is allowing a case against Bayer, regarding its marketing of the birth control device Essure, to proceed. The drug giant asked the court to dismiss the lawsuit, which was brought by five women. The court, however, ruled that two of the womens’ claims – that Bayer used misleading advertising and failed to warn consumers about the risks of the product – were reasonable. Essure has been the center of legal action since Bayer acquired the device. The device, which is placed in the fallopian tube, has been linked to fetal deaths, failures to prevent birth, and sever pain.
Bayer is facing several lawsuits across the country as a result of Essure. Further, at the urging of consumers nationwide, the FDA has investigated the device, and in February issued a warning for the Essure. The FDA has also ordered a study to assess the risks of using Essure.
